This is a legally binding contract between Lauren Vaughan Photography and the clients stated above. It supersedes all previous agreements (verbal or written) between parties. If any party waive or alter part of this agreement, the rest of the agreement remains intact.

Deposit:

A non-refundable, minimum 30% deposit is due at signing. Balance is due 30 days prior to contracted date. Clients assume all responsibility for all collection of legal fees necessitated by default in payment.

Lauren Vaughan Photography accepts cash, checks, and credit cards through our secure and easy payment system. Please note all credit card payments will incur a 3% transaction fee.

In the event clients request additional hours of photography above and beyond chosen package hours in advance of wedding or requests extended hours the day of wedding, clients are responsible for payment of these hours at the rates above. Payment for these additional hours is due in full prior to delivery of images.

If the wedding contract is cancelled by the clients with more than 30 days prior to the wedding, the non-refundable deposit payment will not be returned, it being the agreed loss suffered by the photographer due to cancellation. The clients hereby forfeit their initial deposit in case of cancellation and agree to pay the full amount for the services listed above should they cancel this wedding photography contract within 30 days prior to the wedding date. In the unlikely event the photographer determines that they are unable to complete the coverage due to unforeseen circumstances, an associate photographer will be provided.

If the wedding date is postponed, client is subject to a 10% rescheduling fee, it being the agreed loss suffered by the photographer due to postponement. If photographer is unavailable for rescheduled date, an associate photographer will be provided.

In the unlikely event of total photographic failure or cancellation of this contract by either party or in any circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. Any legal matters shall be held in the photographer’s home state, and any legal fees incurred by the photographer as a result of the clients’ prosecution will be paid by the clients.

The copyright of the photographs is retained by the photographer at all times throughout the world. Where the digital version of the photographs has been included for the clients as part of the wedding collection, these photographs will include a print release and may be printed, and/or displayed online, for personal use. Commercial use must be expressly approved in written form by the photographer and include citation. This includes but is not limited to online bridal publications.

The photographer retains the right to use the photographs for the purpose of advertising or otherwise promotion their work. Clients agree not to sell any of the files or prints without written permission from the photographer. The clients agree that they are signing a model release to allow the use of photographs (of themselves and those pictured at their wedding) for the photographer’s business and promotional purposes.

This clause applies to social media including, but not limited to, Facebook, Instagram, and blogs. When published online, it is required that citation of photographer be made. The clients agree that under no circumstances are they to alter the photographer’s images that are placed in public or on the internet as these images need to remain an accurate representation of photographer’s work, and so that future clients have a good understanding of photographer’s brand and style. The clients agree to be responsible for any family member or friend who posts our photographs online and agrees that they cannot be cropped (with the exception of forced cropping on social media), altered in color, or edited in any way.

All digital photographs will be delivered to the clients no later than 60 days.

USB DELIVERY: Once the files are delivered to the clients, it is the clients’ sole responsibility to protect and retain their images for the future. It is highly recommended that USBs be duplicated and stored in multiple locations in cool dry areas. Replacement USBs can be requested up to 1 year after original date received for an additional fee.

ONLINE GALLERY: An online gallery of images is available for download up to 1 month after delivery. It is highly recommended that the clients download and maintain an archive of all images for future reference. A replacement online gallery can be requested up to 1 year after original date received for an additional fee.

The clients agree that the work delivered will be of a similar style and caliber to those photographs in our website and blog, and that the photographer will have complete creative control during the photographs and in post-processing. The images will be delivered in JPEG format with a mix of color and black and white images and deemed appropriate by the photographer. NO re-editing will be done after the final edited copies are presented to the client. All photographs will be delivered to the clients no later than 60 days after the event.

The clients agree that the photographer can only capture the wedding that happens: weather, location, schedule complications, time restraints and subject’s ability to cooperate, are all factors in the quality of the photographs. The photographer will not edit for physical size, hair, nor any other physical appearance issue other than blemishes.

No clients, wedding guests, attendants, and employees of the clients, may impede the photographer when he/she is shooting or performing duties, failure to comply may result in missed moments or fewer delivered images. Photographer also requests that clients request all phones, tablets, and cameras be put away during the ceremony to capture the best quality images possible. This “unplugged” atmosphere allows no hindrance in the ability to capture spur of the moment reactions and provides better quality photographs. No other professional photographers will be hired by the clients or located on site photographing the clients during the event unless otherwise approved by Lauren Vaughan Photography. This responsibility will fall on clients to ensure all are in compliance.

It is the clients’ responsibility to alert the photographer of any permits required for the wedding. If any venue requires permits for photography, clients are responsible for any and all fees incurred.

Each photographer will be provided a full guest meal for weddings lasting longer than 5 hours. If no meal is provided the photographers reserve the right to go off-site for a meal for 45 minutes. It is highly recommended that the photographers are allowed a meal directly after bridal party to ensure they are finished eating by the time the next activity is scheduled. The photographers will be allowed bathroom breaks when necessary.

THE UNDERSIGNED HAVE READ AND UNDERSTAND THE ABOVE CONTRACT AND AGREE TO THE TERMS AND CONDITIONS IN THEIR ENTIRETY.
